Adeline Rwigara's comments on the court's ruling that her family's hotel is being auctioned off

On Friday morning, the Rwandan Commercial Court overturned an urgent complaint filed by the late Assinapol Rwigara tobacco factory to stop the auction of about 4 of their hotels.

The Premier Tobacco Company has filed a lawsuit seeking the suspension of the Kiyovu Hotel auction, alleging that the permit was issued illegally.

 

The judge ruled that the permit was legally binding. Rwigara's family, however, agreed that they would appeal against the court's decision.

 

Only those on the side of the late Rwigara's tobacco factory were represented in the courtroom. The commercial bank of COGEBANK was not represented.

 

In the case, the insurance company Prime Insurance was asked to reimburse more than 349 million by COGEBANK while it had already paid more than 540 million to the bank in a lawsuit demanding Rwigara's death.

 

Henry Pierre Munyengabe, a lawyer for the bank, said that the existence of a lawsuit did not prevent the auction from continuing because the debt owed to the bank by PTC had not been settled.

 

Janvier Rwagatare, Rwigara's lawyer, said the building permit was illegally issued and that the case did not apply to Rwigara's company because it did not include a party.

 

He explained that Ms. Mukangemanyi was being sued instead of PTC while the judge insisted that the permission to auction the hotel was in accordance with the law.

 

After the trial, Ms Adeline Rwigara told VOA:  "It's a pity, otherwise this is a case of triviality. We felt there was no trial because they openly robbed us and we have evidence. No one is arguing with the burial. We just do what we have to do."

 

She further confirmed that they were going to appeal the decision to auction the hotel.
