The 4-storey building, valued at more than Rwf1 billion owned by the Rwigara Assinapol family, is set to be auctioned off.

The decision was made by the Commercial Court after invalidating the lawsuit filed by Premier Tobacco Company Ltd, claiming that the auction of this building was banned, based on the fact that it had been illegally filed.

 

According to VOA, the claim for the auction on the unfinished floor in Kiyovu is due to a debt owed by the Premier to Cogebank.

 

Defense lawyer Janvier Rwagatare said the reason for the complaint was that the Commercial Court in 2017 had ordered that the four properties of the Rwigara family should not be auctioned off, and that the bank had written a letter to the court stating that there was no debt left to the factory. .

 

Cogebank's lawyer, Mr Henry Pierre Munyengabe, told the court that the company had filed a complaint ignoring the reluctance to write to the secretary-general, which is why it was illegal. He demanded that the complaint be dismissed.

 

The judge of the Commercial Court also found that the company had filed an unlawful complaint because it had to write to the Secretary-General, explaining to him the reasons. He immediately devalued it.

 

Rwigara's family was not satisfied with the judge's decision. Adeline, said she was "not surprised by the court's decision."

 

The flat will be auctioned off on September 17, 2021 using technology. It is expected to go on sale on September 24, 2021, only if it is not yet done, Mr Rwagatare said he was going to expedite the appeal to suspend the operation.
